The ruling party analyzes summoning the members of the court to Congress

“How are we going to rule them out, if they are the defendants?” asked Germán Martínez, with the intention of ratifying that the ruling party does have in mind to summon Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti to the Commission of Political trial of the Chamber of Deputies.

Since December, the Executive’s intention to convene extraordinary sessions to address the pending economic agenda has already been circulating, but the impeachment request to the Supreme Court would generate greater expectations about when the call will be known through the Official Gazette and what the final agenda will be.

Martínez explained yesterday that, in the commission chaired by Carolina Gaillard from Entre Ríos, “in the first stage, a formal analysis of the conditions that support the impeachment is made and a summary is opened. Then comes the evidentiary stage, where one tries to gather as many elements as possible to support the accusation. There you can obviously request the presence of those who are accused. So that’s under review.”

And he continued: “We are going to invite everyone we have to invite. We think that the issue has enormous institutional significance. There have been systematic incursions by the Court into powers that belong to the Judicial Power and the Executive Power. We are talking about institutional aspects that descend to the whole of democracy, whether the Frente de Todos governs or another political space”.

Martínez and Gaillard were the two parliamentary representatives who received the impeachment request from President Alberto Fernández, also signed by Peronist governors.

“First, the President asked us that the request made by him and by the governors of the provinces can have parliamentary processing. This implies the necessary administrative channeling so that we can have the conditions to deal with it in the Impeachment Commission and that we can start the process requested by the President and the governors there.”

He then recounted that “he asked us to be very argumentative, to justify everything, to give the process a lot of institutional seriousness and to try to make it a space with many arguments and few Chicanas. We also found an absolute adherence not only to what the regulations of the Chamber indicate, but also of the Impeachment Commission”.

The commission, which never met in 2022 despite receiving five other requests for impeachment, has 31 members, 16 of whom are from the ruling party. With that number, as long as there is perfect attendance, the Frente de Todos is guaranteed a quorum to debate and the necessary signatures to issue an opinion.

The plan contemplates sixty days of investigation, with the presence of witnesses and defendants, to then give way to the stage of discussion among the legislators themselves. The commission is also made up of 14 deputies from Juntos por el Cambio and the legislator of the Federal Interblock Alejandro “Topo” Rodríguez, who is not willing to give his support to the official plan. “This attempt at impeachment is failing and hurts the country,” argued the Buenos Aires native in dialogue with PROFILE.

As he said, “the argument that the Judiciary would be meddling in the decisions of the National Congress due to the issue of the Council of the Magistracy is an opinion of the Executive Power but it is not the institutional position of the National Congress.”

Rodríguez participates in an interblock of eight members, which sets the tone for the complications that the ruling party has if it takes the issue to the venue, far from the required two-thirds.

The path of impeachment

◆ The FdT would give him an income through the Impeachment Committee of the Lower House.

◆ This commission is made up of 31 members, 16 are from the Frente de Todos, 14 from Juntos por el Cambio and one from the Federal interblock. It is chaired by the official Carolina Gaillard.

◆ This majority will allow the ruling party to move forward with the complaint.

◆ The commission can summon witnesses, request telephone communications and the statement of the accused official. At the end of the investigation, the opinion is issued, which must have the endorsement of half plus one of the members present.

◆ With the ruling, the request for impeachment goes to the court. Two thirds of the Chamber of Deputies is needed. Today it has 118 members out of the 170 it needs.

◆ If approved, it goes to the Senate where the FdT does not have a number either.
